They apply to all users of our website, individuals who submit enquiries, and clients who proceed with booking or coordination services through us.

By accessing our website, communicating with us by email, phone or messaging services, or engaging our services in any way, you confirm that you have read, understood, and agreed to be legally bound by these Terms and Conditions. If you do not agree with any part of these Terms, you should not use our services.

Smile High operates exclusively as a dental tourism facilitation and coordination service. We connect patients with independent dental clinics located abroad and assist with non-clinical aspects of organising treatmentrelated travel. We do not provide dental or medical treatment, do not diagnose medical conditions, and do not replace professional medical advice provided by licensed healthcare professionals.

These Terms are designed to clearly explain our role, the limits of our responsibility, and the obligations of clients who choose to use our services. They also clarify the relationship between the client, Smile High, and the independent dental clinics involved in treatment.

1. About Smile High

Smile High Dental Tourism Agency operates as an independent facilitator between patients and partner dental clinics abroad. Our core role is to simplify and coordinate the process for patients who wish to seek dental treatment overseas.

Our services may include:

  • Providing general information about dental treatment options available through partner clinics

  • Introducing clients to selected independent dental clinics

  • Assisting with treatment enquiries and obtaining preliminary quotes

  • Coordinating communication between clients and clinics

  • Assisting, where requested, with general guidance relating to travel or accommodation arrangements

Smile High does not provide dental, medical, or healthcare services. We are not a healthcare provider, medical institution, or licensed clinical practice. We do not employ dentists and do not perform examinations, diagnostics, procedures, or follow-up care.

Our role is administrative and supportive in nature. Any decision to proceed with treatment is made solely between the client and the chosen clinic. Smile High does not act as a medical advisor and does not make clinical recommendations.

2. Independent Clinics

All dental consultations, diagnoses, treatment plans, procedures, and aftercare services are provided exclusively by independent dental clinics and licensed dentists. These clinics operate as separate legal entities and are not owned, managed, or controlled by Smile High Dental Tourism Agency.

Each clinic is fully responsible for:

  • Conducting clinical assessments and examinations

  • Providing professional medical advice

  • Preparing and issuing treatment plans

  • Performing dental procedures and surgeries

  • Ensuring patient safety and clinical hygiene standards

  • Managing follow-up care and post-treatment support

  • Handling warranties or guarantees relating to dental work

Smile High does not supervise, direct, or control the clinical decisions, medical practices, or professional conduct of any dentist or clinic. All medical judgments, diagnoses, and procedures are made independently by qualified healthcare professionals at the chosen clinic.

Any medical agreement, consent form, or contractual arrangement for dental treatment is entered into directly between the patient and the clinic. Smile High is not a party to the medical contract and does not assume responsibility for the performance, quality, safety, or outcome of treatment provided.

While we aim to collaborate with reputable clinics, we do not provide warranties or guarantees regarding the qualifications, certifications, regulatory compliance, or clinical results of any specific provider. Patients are encouraged to conduct their own due diligence, request full treatment information, and ask the clinic directly about qualifications, experience, and regulatory registration.

In the event of any medical dispute, dissatisfaction, complication, or claim relating to dental treatment, the matter must be addressed directly with the treating clinic. Smile High does not accept liability for clinical negligence, malpractice, unsatisfactory outcomes, or medical complications arising from treatment carried out by independent providers.

Our role remains limited to facilitation and coordination. Clinical responsibility rests entirely with the independent clinic and the licensed dentist performing the treatment.

3. Quotes and Treatment Plans

Any treatment quotes, cost estimates, or preliminary treatment plans shared through Smile High are provided strictly for informational and facilitation purposes. These estimates are typically based on the information, photographs, X-rays, scans, or descriptions supplied by the patient prior to any in-person clinical examination.

All quotes are non-binding estimates and do not constitute a fixed offer or guaranteed final price. Final treatment plans, procedures, and costs may vary following:

  • A physical clinical examination

  • Additional diagnostic imaging (including X-rays, CBCT scans, or impressions)

  • Further medical assessment by the treating dentist

  • Changes in clinical findings not previously disclosed or visible

  • Adjustments required for patient safety or medical suitability

Smile High does not prepare, verify, or medically assess treatment plans. All clinical decisions and pricing structures are determined solely by the treating clinic. We act only as a communication channel to transmit information between the patient and the clinic.

Patients acknowledge and accept that:

  • Initial quotes may change

  • Additional procedures may become necessary

  • Certain treatments may not be clinically suitable after examination

  • Timelines for treatment may be adjusted

  • Prices may vary due to complexity, material choice, or unforeseen clinical factors

Smile High does not guarantee price accuracy, treatment eligibility, availability of specific procedures, or final treatment outcomes. Any financial agreement for dental services is made directly between the patient and the clinic.

Patients are strongly encouraged to request written confirmation of final treatment plans and costs directly from the clinic before commencing any procedure and before making travel arrangements.

Our role is limited to facilitating communication and assisting with coordination. Responsibility for the accuracy, finalisation, and execution of treatment plans lies entirely with the independent dental clinic.

4. Medical Responsibility

Smile High Dental Tourism Agency operates strictly as a dental tourism facilitation and coordination service. We are not a medical provider, dental practice, healthcare institution, or regulated clinical body. We do not employ dentists in the capacity of providing treatment to patients, and we do not carry out any form of clinical examination, diagnosis, treatment planning, medical advice, or healthcare intervention.

All dental treatments, procedures, consultations, and medical services are delivered exclusively by independent dental clinics and licensed dental professionals. These clinics are separate legal entities that operate under their own regulatory, licensing, and professional obligations within their respective jurisdictions.

4.1 No Provision of Medical Advice

Any information provided by Smile High — whether via website content, email communication, telephone, messaging platforms, or marketing materials — is intended solely for general informational and coordination purposes. Such information does not constitute:

  • Medical advice

  • Dental advice

  • Diagnosis

  • Prescription

  • Clinical recommendation

  • Treatment guarantee

Patients must rely solely on the professional advice and clinical judgment of the treating dentist or clinic. Smile High does not assess medical suitability, review radiographs for diagnostic purposes, or provide second opinions.

4.2 Exclusive Clinical Responsibility of the Treating Clinic

The independent clinic and licensed dentist are solely and fully responsible for all medical aspects of care, including but not limited to:

  • Reviewing medical and dental history

  • Conducting in-person examinations

  • Determining treatment suitability

  • Discussing risks, benefits, and alternatives

  • Obtaining informed consent

  • Performing procedures and surgeries

  • Providing prescriptions

  • Ensuring sterilisation and infection control standards

  • Monitoring healing and recovery

  • Delivering follow-up and aftercare

  • Addressing complications or corrective procedures

Smile High does not supervise, manage, or control the clinical methods, standards, materials used, or professional conduct of any dentist or clinic. We do not interfere in clinical decisions and do not assume any duty of medical care toward patients.

4.3 Inherent Risks of Dental Treatment

Clients acknowledge that dental and surgical treatments involve inherent risks. These may include, but are not limited to:

  • Pain or discomfort

  • Swelling or bruising

  • Infection

  • Allergic reactions

  • Implant failure

  • Nerve sensitivity or nerve damage

  • Cosmetic dissatisfaction

  • Need for revision or additional treatment

  • Unforeseen complications due to underlying conditions

Responsibility for explaining these risks, managing complications, and determining appropriate remedial action lies entirely with the treating clinic and dentist.

4.4 No Liability for Clinical Outcomes

To the fullest extent permitted by applicable law, Smile High shall not be liable for:

  • Clinical negligence or malpractice

  • Errors in diagnosis

  • Unsuitable treatment recommendations

  • Surgical complications

  • Dissatisfaction with aesthetic or functional results

  • Failure or breakdown of dental restorations

  • Long-term durability of treatments

  • Post-treatment discomfort or medical complications

  • Any direct, indirect, incidental, or consequential damages arising from dental treatment

Any dispute, claim, complaint, or legal matter relating to dental treatment must be addressed directly with the clinic that performed the procedure.

4.5 No Assumption of Duty of Care

By using our services, clients expressly acknowledge and agree that:

  • Smile High acts solely as a facilitator and intermediary.

  • We do not assume medical duty of care.

  • No doctor–patient relationship exists between the client and Smile High.

  • All medical agreements are entered into directly between the client and the clinic.

Our role is strictly limited to assisting with introductions, communication, and logistical coordination. Full medical responsibility rests entirely and exclusively with the independent clinic and the licensed dental professionals providing treatment.

5. Travel Arrangements

Smile High Dental Tourism Agency may, upon request, assist clients with general guidance and coordination relating to travel and accommodation arrangements connected to their dental treatment abroad. This assistance may include recommending flights, hotels, airport transfers, local transportation providers, or other logistical services to facilitate a smooth treatment journey.

However, Smile High is not a licensed travel agency, tour operator, airline, transportation provider, or accommodation provider. We do not own, operate, or control any airline, hotel, transport company, or travel service provider. Any travel-related service is provided by independent third parties, each operating as separate legal entities under their own terms and conditions.

5.1 Scope of Assistance

Our role in relation to travel arrangements is strictly limited to:

  • Providing general recommendations

  • Facilitating introductions to travel or accommodation providers

  • Assisting with coordination upon client request

  • Sharing publicly available travel information

We do not guarantee availability, pricing, schedules, quality, safety standards, or performance of third-party travel services.

5.2 Client Responsibility

Clients are solely responsible for:

  • Booking and confirming flights and accommodation

  • Ensuring passport validity

  • Obtaining any required visas or entry permits

  • Complying with immigration rules

  • Arranging appropriate travel and medical insurance

  • Meeting airline and border health requirements

  • Understanding local laws and regulations

  • Ensuring they are medically fit to travel

Smile High does not verify visa eligibility, entry requirements, or travel restrictions. It is the client’s responsibility to consult official government sources prior to travel.

5.3 No Liability for Travel Disruptions

To the fullest extent permitted by law, Smile High shall not be liable for:

  • Flight delays or cancellations

  • Lost luggage

  • Hotel overbookings or accommodation disputes

  • Transportation delays

  • Travel strikes or force majeure events

  • Natural disasters

  • Political instability

  • Changes in border control policies

  • Additional travel costs incurred

  • Missed appointments due to travel disruptions

Any contractual relationship for travel services exists solely between the client and the third-party provider.

5.4 Insurance

Clients are strongly advised to obtain comprehensive travel insurance and, where appropriate, medical travel insurance that covers:

  • Trip cancellation

  • Travel delays

  • Medical emergencies

  • Treatment complications

  • Extended stays due to recovery

  • Repatriation if necessary

Smile High does not provide insurance services and is not responsible for uninsured losses.

Our involvement in travel arrangements is purely administrative and supportive in nature. All risks and responsibilities associated with travel remain exclusively with the client and the respective third-party travel providers.

6. Payments

Smile High Dental Tourism Agency operates primarily as a facilitator between patients and independent dental clinics. In most cases, payments for dental consultations, procedures, and clinical services are made directly by the client to the chosen clinic. Smile High does not act as a financial intermediary for medical treatment unless explicitly agreed in writing.

6.1 Payments to Dental Clinics

All fees relating to dental treatment — including deposits, staged payments, or final balances — are determined solely by the independent clinic providing the treatment. Payment terms, accepted methods of payment, currency, refund policies, and instalment arrangements are governed by the clinic’s own financial policies and contractual terms.

Smile High:

  • Does not set clinical pricing

  • Does not control clinic billing systems

  • Does not guarantee final treatment costs

  • Is not responsible for currency exchange fluctuations

  • Is not liable for payment disputes between client and clinic

Any financial agreement for dental services is entered into directly between the patient and the treating clinic.

6.2 Service or Coordination Fees

In certain circumstances, Smile High may charge a separate service, administration, or coordination fee for facilitation services provided. Where applicable, such fees will be clearly communicated in advance, including:

  • The amount payable

  • What the fee covers

  • Payment deadlines

  • Whether the fee is refundable or non-refundable

Any Smile High service fee is independent from clinical treatment costs and relates solely to facilitation and coordination services.

6.3 Deposits

Clinics may require a deposit to secure treatment dates. Deposits are subject to the clinic’s own cancellation and refund policies. Smile High does not control or override clinic deposit terms.

If Smile High collects a deposit on behalf of a clinic (only where expressly agreed), such funds may be transferred to the clinic according to prior arrangement. Once transferred, refund responsibility rests with the clinic.

6.4 Currency and Exchange Rates

Where treatment is priced in a foreign currency, final amounts payable may vary due to exchange rate fluctuations or bank transfer charges. Smile High is not responsible for:

  • Exchange rate differences

  • International bank fees

  • Payment processing fees

  • Credit card surcharges

  • Currency conversion losses

Clients are advised to confirm payment details directly with the clinic before transferring funds.

6.5 Payment Disputes

Any dispute regarding:

  • Treatment pricing

  • Additional clinical costs

  • Refunds

  • Instalment agreements

  • Financial disagreements

must be addressed directly between the client and the treating clinic. Smile High does not mediate financial disputes unless voluntarily assisting in communication without assuming liability.

6.6 No Financial Liability

To the maximum extent permitted by law, Smile High shall not be liable for:

  • Financial losses relating to clinic payments

  • Treatment fee increases

  • Non-refundable deposits

  • Disputed charges

  • Credit card or bank transaction errors

Our role remains strictly limited to facilitation and coordination. Financial responsibility for clinical services rests solely with the independent clinic and the client entering into agreement with that clinic.

7. Cancellations and Changes

Clients who wish to cancel, postpone, or modify scheduled dental treatment must notify the treating clinic directly as soon as possible. As dental services are provided by independent clinics, cancellation policies, refund eligibility, and rescheduling conditions are determined solely by the clinic and not by Smile High Dental Tourism Agency.

7.1 Clinic Cancellation Policies

Each clinic may have its own written policy governing:

  • Deposit refunds

  • Minimum notice periods

  • Administrative fees

  • Rescheduling limitations

  • Missed appointment charges

  • Partial refunds for incomplete treatment

Clients are responsible for reviewing and understanding the clinic’s cancellation terms before confirming treatment dates or paying any deposit.

Smile High does not control or override clinic cancellation policies and cannot guarantee refunds under any circumstances.

7.2 Deposits and Advance Payments

Where a clinic requires a deposit to secure treatment dates:

  • Deposits may be non-refundable.

  • Refunds (if applicable) are processed according to the clinic’s policy.

  • Administrative or laboratory costs already incurred may be deducted.

If Smile High has assisted in transferring a deposit to a clinic, any refund decision rests entirely with the clinic once funds have been passed on.

7.3 Travel-Related Cancellations

Smile High is not responsible for:

  • Flight cancellation penalties

  • Non-refundable accommodation costs

  • Lost travel expenses

  • Insurance excess payments

  • Visa application fees

  • Additional travel costs resulting from treatment rescheduling

Clients are strongly advised to obtain comprehensive travel insurance that covers cancellation and medical-related changes.

7.4 Changes Due to Medical Reasons

If a clinic determines that treatment cannot proceed due to medical findings discovered during examination, the clinic’s own refund or rescheduling policy will apply. Smile High is not liable for:

  • Travel costs already incurred

  • Time off work

  • Accommodation expenses

  • Other indirect financial losses

7.5 Failure to Attend

If a client fails to attend a scheduled appointment without sufficient notice, the clinic may retain any deposit paid and may refuse to reschedule without additional payment. Such decisions are made solely by the clinic.

7.6 Force Majeure

Neither Smile High nor the clinic shall be held responsible for cancellations or delays caused by circumstances beyond reasonable control, including but not limited to:

  • Natural disasters

  • Government travel restrictions

  • Public health emergencies

  • Political instability

  • Airline disruptions

  • Acts of God

In such cases, any refunds or rescheduling will be subject to the clinic’s and third-party providers’ policies.

7.7 No Liability

To the fullest extent permitted by law, Smile High shall not be liable for financial loss, inconvenience, or damages arising from cancellations, postponements, rescheduling, or missed appointments related to dental treatment or travel arrangements.

Our role is limited to communication and coordination assistance. All contractual rights and obligations concerning cancellations and changes remain exclusively between the client and the independent dental clinic.

8. No Guarantee of Results

Dental and cosmetic dental treatments involve clinical procedures whose outcomes may vary from patient to patient. Smile High Dental Tourism Agency does not provide medical treatment and does not guarantee the success, durability, appearance, or longevity of any dental procedure performed by independent clinics.

8.1 Variability of Outcomes

Clients acknowledge that treatment results depend on numerous factors, including but not limited to:

  • Individual oral health condition

  • Bone density and gum health

  • Pre-existing dental issues

  • Healing response and biological factors

  • Compliance with aftercare instructions

  • Lifestyle factors (e.g., smoking, oral hygiene, diet)

  • Ongoing maintenance and follow-up care

As such, no specific outcome can be promised or assured.

8.2 Cosmetic Expectations

Where treatment is cosmetic in nature (including veneers, crowns, whitening, or smile design), aesthetic results are inherently subjective. While clinics may provide visual simulations or before-and-after examples, such materials are illustrative only and do not constitute a contractual guarantee of identical results.

Smile High does not guarantee:

  • Exact colour matching

  • Perfect symmetry

  • Specific cosmetic appearance

  • Permanent results without maintenance

  • Absence of future complications

8.3 Implant and Restorative Treatments

Procedures such as dental implants, bridges, crowns, and other restorative work may require maintenance, replacement, or adjustment over time. Failure rates, biological rejection, or technical complications may occur despite proper clinical care.

Any warranty or guarantee relating to dental work is provided solely by the treating clinic under its own written terms and conditions. Smile High does not provide warranties and does not assume responsibility for honouring clinic guarantees.

8.4 No Representation or Warranty

To the fullest extent permitted by law, Smile High makes no representations or warranties, express or implied, regarding:

  • Clinical effectiveness

  • Treatment success rates

  • Long-term durability

  • Freedom from complications

  • Patient satisfaction

All representations regarding outcomes must be obtained directly from the treating clinic.

8.5 Patient Acknowledgment

By using our services, clients acknowledge that:

  • Dental procedures carry inherent risks.

  • Results cannot be guaranteed.

  • Further treatment may be required in the future.

  • Smile High is not responsible for treatment performance or outcome.

Our role is strictly limited to facilitation and coordination. Any guarantee, warranty, or assurance regarding clinical results must be provided directly by the independent dental clinic responsible for treatment.

9. Limitation of Liability

This section defines the extent of Smile High Dental Tourism Agency’s legal responsibility in relation to the services we provide. It is an important clause because it clarifies the boundaries between our role as a facilitation agency and the independent responsibilities of dental clinics, travel providers, and other third parties involved in your journey.

Smile High Dental Tourism Agency operates solely as a non-clinical intermediary and coordination service. We do not provide healthcare, dental treatment, diagnosis, surgery, prescriptions, or any form of medical intervention. We also do not operate as a travel agency, insurance provider, or financial institution. As such, our legal liability is strictly limited to the facilitation services we directly provide.

By using our services, you acknowledge and agree that Smile High is not responsible for any actions, omissions, decisions, or services provided by third parties, including dental clinics, dentists, hospitals, travel providers, accommodation providers, or transport companies.

9.1 No Responsibility for Medical Outcomes

All dental treatments are performed by independent licensed dental professionals. Smile High has no control over clinical decisions or medical procedures. Therefore, we are not liable for any medical or clinical outcomes, including but not limited to:

  • Incorrect diagnosis or treatment planning

  • Surgical or procedural complications

  • Infection or post-treatment complications

  • Implant or prosthetic failure

  • Nerve damage, pain, or sensitivity

  • Allergic reactions or adverse medical responses

  • Unsatisfactory cosmetic or functional results

  • Need for additional or corrective treatment

  • Long-term treatment failure or deterioration

All medical responsibility rests entirely with the treating clinic and the licensed dentist performing the treatment.

9.2 No Responsibility for Travel and Logistics

Where we assist with travel-related coordination, such assistance is strictly informational and supportive. We are not responsible for any travel arrangements made by the client or third-party providers. This includes:

  • Flight delays, cancellations, or missed connections

  • Airline operational issues

  • Lost or delayed luggage

  • Hotel overbooking, cancellation, or service quality

  • Transportation delays or disruptions

  • Visa refusals or entry restrictions

  • Immigration issues

  • Local regulatory changes or travel bans

  • Public health emergencies affecting travel

All travel arrangements are undertaken at the client’s own risk and responsibility.

9.3 No Responsibility for Financial Loss

Smile High is not responsible for any financial losses arising from the use of our services or from third-party arrangements. This includes:

  • Treatment cost changes or additional charges imposed by clinics

  • Currency exchange fluctuations

  • Bank fees or international transfer charges

  • Non-refundable deposits paid to clinics or travel providers

  • Costs arising from rescheduling or cancellation

  • Accommodation or flight losses

  • Loss of income due to travel or treatment time

  • Any indirect financial consequences

All financial agreements relating to dental treatment are made directly between the client and the clinic.

9.4 No Responsibility for Third-Party Services

Any third-party service providers (including dental clinics, laboratories, hotels, airlines, transport providers, or insurance companies) act independently of Smile High. We do not control, supervise, or guarantee their services. Accordingly, we are not responsible for:

  • Service quality or performance

  • Contractual disputes between client and provider

  • Regulatory compliance of third parties

  • Errors, omissions, or negligence by third parties

  • Breach of contract by external providers

9.5 Indirect, Consequential, and Non-Direct Losses

To the maximum extent permitted by law, Smile High shall not be liable for any indirect or consequential losses arising from the use of our services. This includes, but is not limited to:

  • Loss of profit or business opportunities

  • Emotional distress or inconvenience

  • Loss of enjoyment of travel or treatment experience

  • Reputational damage

  • Additional accommodation or travel expenses

  • Loss of time or productivity

  • Psychological impact or dissatisfaction

9.6 Liability Cap

Where liability cannot be excluded under applicable law, the total aggregate liability of Smile High shall be strictly limited to the amount of service fees actually paid directly to Smile High for facilitation services, if any.

9.7 Force Majeure

Smile High shall not be liable for any failure or delay in performance caused by events beyond our reasonable control. Such events may include:

  • Natural disasters

  • Pandemics or epidemics

  • Government restrictions or policy changes

  • War, terrorism, or civil unrest

  • Strikes or industrial action

  • Cyberattacks or system failures

  • Power or infrastructure failures

  • Airline or transport disruptions

  • Any other unforeseen force majeure events

9.8 Legal Safeguards and Non-Excludable Liability

Nothing in this clause is intended to exclude or limit liability for:

  • Fraud or fraudulent misrepresentation

  • Death or personal injury caused by proven negligence of Smile High

  • Any liability that cannot be excluded under applicable law

9.9 Client Acknowledgment

By using Smile High services, you explicitly acknowledge that:

  • We act only as a facilitator between you and independent service providers

  • We do not control clinical, medical, travel, or financial outcomes

  • You accept all inherent risks associated with dental treatment and international travel

  • You are responsible for making informed decisions in consultation with the clinic and other providers

10. Client Responsibilities

This section sets out the obligations and responsibilities of any individual (“Client”, “you”, or “your”) who uses the services of Smile High Dental Tourism Agency. By engaging with our services, submitting enquiries, or proceeding with treatment coordination, you agree to comply with the responsibilities outlined below.

Smile High provides a facilitation service only. The success, safety, and outcome of any dental treatment or travel arrangement depends significantly on the accuracy of the information provided by the Client and the Client’s cooperation with both Smile High and the independent dental clinic.

10.1 Accuracy of Information

You are fully responsible for ensuring that all information you provide to Smile High and/or partner clinics is true, complete, and accurate.

This includes, but is not limited to:

  • Personal identification details

  • Medical and dental history

  • Existing health conditions

  • Current medications

  • Allergies or sensitivities

  • Previous dental treatments or surgeries

  • X-rays, scans, or photographs provided

  • Any relevant travel or mobility limitations

Failure to disclose accurate or complete information may result in:

  • Incorrect treatment planning

  • Medical complications

  • Treatment delays or cancellation

  • Additional costs

  • Unsuitable clinical outcomes

Smile High accepts no responsibility for consequences arising from incomplete or inaccurate information provided by the Client.

10.2 Communication with Clinics

Clients are responsible for maintaining clear and direct communication with the treating clinic regarding:

  • Treatment plans and procedures

  • Medical suitability and risks

  • Appointment scheduling

  • Pre-treatment requirements

  • Aftercare instructions

  • Consent forms and clinical documentation

While Smile High may assist in facilitating communication, all clinical discussions must take place between the Client and the dental professional.

10.3 Informed Consent

Clients acknowledge that all dental treatments require informed consent, which is provided directly to the clinic before any procedure is carried out.

It is the Client’s responsibility to:

  • Read and understand all treatment documentation
